The non-criminal Police Service Act charges against Unit 11 Division Commander Joyce Schertzer date from an incident that occurred on May 1.
Hearing documents obtained by CP24 claim that Schertzer was working at 11 Division when she received a call from her daughter, who told her that her nephew had been in a “bad accident.”
The documents allege that Schertzer arranged for an officer from her department to be “sent” to the 14th Precinct where the crash occurred, bypassing the usual priority system “for the benefit of your family.”
Schertzer then attended the scene herself and “actively participated in the investigation,” the documents allege.
“When he was on stage, you spoke to your nephew first.  You gathered information about the conflict and actively participated in the investigation.  You then had a private conversation with the investigator and your nephew was told he could leave the scene,” the documents state.
Hearing documents note that it was necessary for members of the Toronto Police Traffic Services Specialist Unit to attend the scene due to the fact that the vehicle had damaged city property.
But the documents claim the officer tasked with leading the investigation “didn’t have an opportunity to determine if alcohol could have been a factor” because the driver was allowed to leave the scene.
“The investigation was discontinued as a result of your nephew’s removal from the scene,” the documents state.  “As the senior officer and supervisor on the scene, you failed to ensure that a thorough investigation was conducted into the collision.  Furthermore, you failed to note down the statement given by the driver, your nephew.”
Schertzer is a former homicide detective who is second in command in the 11th Division.
He is charged with disorderly conduct, insubordination and dereliction of duty in connection with the May incident.
Her first appearance in police court was scheduled for Tuesday morning.
None of the charges have been proven in court.
